Acting Chair Weis called the meeting to order at 7:05 p.m.

A       Meeting Minutes:

Motion:  A motion was made by J. O’Connell and seconded by D. Powell to approve the minutes of December 5, 2012 as written.  The motion passed unanimously.

B.      101 Newburyport Turnpike:

Town Counsel has reviewed and approved the form of the Performance Bond for the work to be done on Sled Road.  The Board set a completion date for the work of November 14, 2014.

Motion:  A motion was made by J. O’Connell and seconded by D. Powell to recommend to the Selectmen that they accept Form F, Assignment of Security, from Angelo Ciardiello, ERA Equipment, for work to be performed on Sled Road, a Town-owned way, in connection with improvements to the property at 101 Newburyport Turnpike.  The motion passed unanimously.

J. O’Connell reported on a visit that he, M. Taylor, and Doug Packer, Conservation Agent, made to the site on December 18.  They noted that the silt fence had been compromised by earth moving activities that had taken place after the fence was installed.  D. Packer has followed up with the applicant.

C.      Marsh Meadow OSRD and Preservation Restriction:

M. Taylor reported that Town Counsel has reviewed and approved the Conservation Restriction for the Marsh Meadow Subdivision.

Motion:  A motion was made by J. O’Connell and seconded by D. Powell to recommend that the Marsh Meadow OSRD Conservation Restriction be accepted by the Conservation Commission and the Board of Selectmen.  The motion passed unanimously.

The status of the water easement and the access easement to the open space is to be verified.

The Preservation Restriction on the farmhouse and barn is to be coordinated with the revised OSRD Special Permit language.


D.      Caldwell Farm Trail:
        
D. Powell reported on continuing discussions aimed at moving forward with a trail through the Caldwell Farm subdivision.

E.      Proposed Zoning Amendments for the Annual Town Meeting:

K. Pearson and M. Taylor will review the Table of Use Regulations to identify items which should be revised.  M. Taylor will coordinate with the Building Inspector regarding suggested changes to the Accessory Apartment By-Law.  A draft Solar Energy By-Law is to be ready for review by the second meeting in January.

F.      Subdivision Rules and Regulations/Stormwater Regulations:

Article III of the revised Subdivision Rules and Regulations was reviewed by the Board.  Additional articles will be reviewed at the next meeting.

G.      Stormwater:

J. O’Connell announced a public education session for children on stormwater/water pollution that is to be held at the Parker River Wildlife Refuge Headquarters on April 27, 2013, from 9:00 a.m. to noon.
On a motion made by J. O’Connell and seconded by D. Powell, the meeting was adjourned at 10:05 p.m.
